CALL FOR YOUR FREE CONSULTATION WITH FLORIDA BAR BOARD CERTIFIED CIVIL TRIAL LAWYER, MARK J. LEEDS.

IF THERE IS NO RECOVERY, WE DO NOT CHARGE YOU ATTORNEY’S FEES OR COSTS. NOTE: The Florida Bar has no specific categories of lawyer for individual types of cases within the area of personal injury.

Mark J. Leeds is a Florida Airplane Accident Lawyer familiar with aviation accident disaster claims who has represented victims of COPA Airline Flight 201 and the ValuJet disaster in the Everglades.

YOUR FIRST CONSULTATION:

Your Florida Airplane Accident Lawyers will need to make the important decisions of where and what companies to sue. The tactical choice of where to sue often can make a difference in the time it takes to obtain a jury trial, the potential makeup of the jury, the history of past verdicts in that locale, and the rules and regulations for the presentation of evidence. The choice of where to sue is also complicated by the fact that sometimes the choice is State, Federal, or International, depending on a multitude of factors. Such factors include the nationality of the victims, if the flight was originating in the USA and was international in intent, the reason for the crash and the identity of and locations of the defendants.

MATERIALS YOU SHOULD GATHER:

These materials apply to wrongful death aviation accidents:

• Medical bills and records, if applicable and you have them
• Funeral bills, if applicable
• Death Certificate, if applicable
• Life insurance information, if applicable
• Travel insurance information, if applicable
• Names and addresses of all dependants, if any
• Marriage certificate of spouse and birth certificate of all dependents, if applicable
• Employment history of decedent, if applicable
• Tax returns of decedent, if applicable

DEADLINE FOR FILING A LAWSUIT:

I cannot comment on the Statute of Limitations here in Florida for Aviation Disaster cases, because there may be significant statutes of limitations involved in the variety of jurisdictions where suit may be brought, and I am not licensed to practice in all of them.

The Florida Wrongful Death Act does apply a two year time limit for all wrongful death claims under Florida Law.

Please note that the Statute of Limitations or time limit bar upon preserving your legal rights may vary and have very technical requirments. Do not rely just upon the above simple statements and generalities. The point is to consult your Florida Air Crash Lawyer as soon as possible so as to preserve your legal rights.

THE LIMIT ON PAIN AND SUFFERING DAMAGES:

There are sometimes limits on damages for International flights under “The Warsaw Convention,” a specific treaty type regulation. The Warsaw Convention is a 1929 agreement that limits the liability of airlines in the event of "accidents" on international flights. In 1966, the top limit was increased to $75,000. This limit does not apply in the event of the airline's "willful misconduct," a subject that is frequently and fiercely litigated.
